The Judiciary is one of the three Arms of Government established under Chapter 10, Article 159 of the Constitution of Kenya, established as an independent custodian of justice in Kenya. The Judiciary’s primary role is to exercise judicial authority derived from the people of Kenya.
In exercising judicial authority, the Judiciary is guided by the following principles
Justice shall be done to all, irrespective of status
Justice shall not be delayed
Alternative forms of dispute resolution including reconciliation, mediation, arbitration and traditional dispute resolution mechanisms shall be promoted
Justice shall be administered without undue regard to procedural technicalities
The purpose and principals of the Constitution of Kenya 2010 shall be protected and promoted
